Acceptance of Terms

Welcome to Deaf Caption ("the App").

The App is developed and operated by Jason Schwebke ("Developer," "we," "our," or "us"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms of Use ("Terms").

If you do not agree to these Terms, do not use the App.

Description of the App

Deaf Caption is an accessibility application designed to assist communication between deaf, hard-of-hearing, and hearing individuals through speech-to-text captioning, text-to-speech functionality, and related accessibility features.

The App is intended as a communication aid and convenience tool only.

License Grant

Subject to your compliance with these Terms and any applicable App Store terms, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control.

This license is granted solely for personal, non-commercial use unless otherwise permitted by applicable law.

Apple App Store Terms

The App is distributed through Apple's App Store.

Your use of the App is also subject to any applicable terms, policies, and requirements established by Apple.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as applicable.

Accessibility Disclaimer

Speech recognition and text-to-speech technologies are not perfect and may produce inaccuracies, omissions, delays, or transcription errors.

The App is intended to improve accessibility and communication. However, speech recognition and text-to-speech technologies are not guaranteed to be accurate.

Users should not rely solely on the App when accurate communication is critical, including but not limited to:

  • Medical situations
  • Emergency situations
  • Legal proceedings
  • Law enforcement interactions
  • Financial transactions
  • Safety-critical communications

Users are responsible for independently verifying important information.

No Professional Advice

The App does not provide medical, legal, financial, emergency, or professional advice.

Any information displayed, transcribed, or generated by the App is provided solely for general informational and accessibility purposes.

User Responsibilities

You agree to use the App lawfully and responsibly.

You agree not to:

  • Use the App in violation of any law or regulation.
  • Attempt to reverse engineer, decompile, or modify the App except where permitted by law.
  • Interfere with the operation or security of the App.
  • Use the App in a manner that could harm others or infringe upon their rights.

You are solely responsible for your use of captions, transcriptions, speech output, and any content generated through the App.

In-App Purchases and Subscriptions

The App may offer optional paid features through Apple's StoreKit framework.

Available purchase types may include:

  • Auto-renewable subscriptions
  • One-time purchases
  • Non-consumable purchases

Premium features may include, but are not limited to:

  • Sharing transcription content
  • Continuous captioning without interruptions
  • Additional accessibility enhancements

All purchases are processed by Apple through the App Store.

Subscription Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current subscription period.

Your account will be charged for renewal within 24 hours before the end of the current period.

You may manage or cancel subscriptions through your Apple Account settings.

Refunds

Refund requests are handled by Apple in accordance with App Store policies.

The Developer does not issue refunds directly for App Store purchases.

Intellectual Property

The App, including its software, design, features, trademarks, logos, graphics, and content, is owned by the Developer and protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, no rights are granted to you.

Privacy

Your use of the App is also governed by the Deaf Caption Privacy Policy.

The Privacy Policy explains how information is handled within the App.

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE."

THE DEVELOPER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY
  • RELIABILITY
  • AVAILABILITY

THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL OPERATE WITHOUT INTERRUPTION, ERROR, OR INACCURACY.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO:

  • Use of the App
  • Inability to use the App
  • Transcription errors
  • Speech recognition errors
  • Data loss
  • Device issues
  • Business interruption

IN NO EVENT SHALL THE DEVELOPER'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE APP DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Indemnification

You agree to defend, indemnify, and hold harmless the Developer from any claims, damages, liabilities, costs, and expenses arising from:

  • Your use of the App;
  • Your violation of these Terms;
  • Your violation of any law or third-party rights.

Termination

The Developer may suspend or terminate access to the App if you violate these Terms or if required by law.

Upon termination, all rights granted under these Terms immediately cease.

Changes to These Terms

The Developer may update these Terms from time to time.

Updated Terms will be posted on the App's website and become effective upon posting unless otherwise stated.

Continued use of the App after changes are posted constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to conflict of law principles.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
